By downloading, installing, or using the Peaches' Guide to the Hayduke Trail application ("the App") or accessing the website at hayduke.trailpeaches.com ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App or Service.
Peaches' Guide provides digital trail maps, GPS navigation, waypoint information, water reports, and community condition reports for long-distance hiking trails. The App is designed to supplement, not replace, proper backcountry preparation including physical maps, navigation skills, and current conditions research.
To access certain features you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 13 years old to create an account.
You agree not to:
When you submit trail condition reports, comments, or other content ("User Content"), you grant Trail Peaches a worldwide, non-exclusive, royalty-free, perpetual license to use, display, reproduce, and distribute that content within the Service. You retain ownership of your User Content but acknowledge it may be visible to other users.
You represent that your User Content does not infringe any third party's rights and is accurate to the best of your knowledge. We reserve the right to remove any User Content at our discretion.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
TRAIL DATA, WATER REPORTS, GPS POSITIONS, AND WAYPOINT INFORMATION ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY. THEY MAY BE INACCURATE, INCOMPLETE, OR OUTDATED. DO NOT RELY SOLELY ON THIS APP FOR BACKCOUNTRY NAVIGATION OR SAFETY DECISIONS.
We do not warrant that:
Backcountry travel is inherently dangerous. Always carry physical maps, check current conditions with land management agencies (BLM, NPS, USFS), carry adequate water, and inform others of your plans.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAIL PEACHES, ITS OWNER (JEFF KESSLER), AND ANY CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, DEATH, PROPERTY DAMAGE, LOST DATA, OR LOST PROFITS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, THE APP, OR ANY DATA PROVIDED THEREIN.
This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.
You expressly acknowledge that Jeff Kessler, as an individual, shall have no personal liability whatsoever arising from your use of the App, the Service, or any data or content provided through them.
You acknowledge that hiking, especially on remote cross-country routes like the Hayduke Trail, is an inherently dangerous activity. Risks include but are not limited to: dehydration, heat illness, hypothermia, flash floods, falls, wildlife encounters, getting lost, lack of emergency services, and death. These risks exist regardless of the quality or accuracy of any trail information provided.
YOU VOLUNTARILY ASSUME ALL RISKS associated with your outdoor activities and expressly release and discharge Trail Peaches, Jeff Kessler, and all contributors from any and all claims, demands, causes of action, damages, or liabilities arising from or related to your use of the App or Service in connection with outdoor activities.
The App and all trail data, water reports, GPS coordinates, and waypoint information are provided strictly as informational aids. They are not a substitute for proper backcountry skills, physical maps, current conditions research with land management agencies, adequate supplies, and sound personal judgment.
You agree to indemnify, defend, and hold harmless Trail Peaches, Jeff Kessler, and any contributors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:
ALL TRAIL DATA, WATER REPORTS, GPS COORDINATES, WAYPOINT LOCATIONS, ELEVATION PROFILES, ALTERNATE ROUTES, AND ANY OTHER INFORMATION PROVIDED THROUGH THE APP AND SERVICE ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. This data is compiled from multiple community sources, may contain errors, and may be outdated. Trail conditions change constantly due to weather, flooding, landslides, and other natural processes.
You acknowledge that you use all data at your own risk and that neither Trail Peaches nor Jeff Kessler guarantees the accuracy, completeness, reliability, or timeliness of any information provided.
Certain features may require a paid subscription or one-time purchase. Payments are processed through Apple App Store or Google Play Store and are subject to their respective terms. Refund requests must be directed to the applicable app store.
The App, its design, code, icons, and original trail data compilations are the property of Trail Peaches and are protected by copyright and other intellectual property laws. Community-contributed water reports and condition reports remain subject to the license granted in Section 5.
Some trail data, waypoints, route information, and descriptions in the App and Service have been compiled from publicly available sources on the internet, including community-created guides, trip reports, and open data. We respect the intellectual property and contributions of other trail creators, guidebook authors, and community members.
If you are the original creator or rights holder of any data, waypoints, route descriptions, or other content included in the Service and you would like it removed, please contact us at [email protected] with:
We will respond to all legitimate removal requests promptly and in good faith, typically within 14 days. We are committed to respecting the work of fellow trail community members and will comply with reasonable takedown requests without requiring formal legal action.
This policy applies equally to DMCA copyright claims. If you believe any content in the Service infringes your copyright, you may submit a DMCA takedown notice to [email protected].
We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time by contacting [email protected].
We may update these Terms from time to time. The "Last updated" date will reflect the most recent revision. Continued use of the Service after changes constitutes acceptance of the revised Terms. Material changes will be communicated via email or in-app notification.
These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in California.
